Hong Kong adoption is not free, but it is significantly less expensive than adoption in the United States or Australia. The total cost for a local adoption through SWD typically runs from HK$15,000 to HK$35,000 depending on whether you use a solicitor, which Accredited Body you work with, and whether any complications arise in the court process.

Here's where the money goes.

What's Free

If you apply directly through SWD's Adoption Unit, the social work assessment — the home study — is provided at no charge. SWD is a government department; its services are funded publicly. The same applies to SWD-run adoption training workshops and briefing sessions.

This is the primary cost advantage of going directly through SWD versus an Accredited Body. If your circumstances are straightforward (Hong Kong local adoption, no intercountry elements), and you're comfortable navigating government processes, SWD direct is the lowest-cost route.

Guardian ad Litem Fee: HK$4,670

This is a mandatory fee, not optional. When you file for an Adoption Order in the District Court, the court appoints a Guardian ad litem — an independent officer (typically a solicitor) who investigates the case and reports to the court on whether the adoption is in the child's best interests.

The Guardian ad litem fee is set by government schedule. As of January 2026, the fee is HK$4,670 per child. This applies to every adoption that goes through the District Court, regardless of whether you use a solicitor yourself.

You pay this fee to the court registry when filing your application. It is not negotiable and not waivable.

Court Filing Fees

District Court adoption proceedings involve a filing fee for the originating summons. Court fees in Hong Kong are set by the Rules of the District Court. For adoption applications, expect to pay in the range of HK$1,000–HK$2,500 in filing fees, depending on the nature of the application (straightforward adoption order versus more complex contested or intercountry matters).

If the adoption involves an intercountry element handled under Cap. 290D (Convention Adoption Rules), the High Court may have jurisdiction for certain steps, and High Court filing fees are higher.

Solicitor Costs: HK$8,000–HK$25,000

You are not legally required to use a solicitor for a domestic adoption. Some families handle the District Court application themselves. In practice, most use a family law solicitor, particularly if:

  • This is an intercountry adoption (complex international legal requirements)
  • The biological parents' consent requires formal handling under Cap. 290
  • A "freeing order" is involved (where the court formally dispenses with parental consent)
  • There are any complications in the biological parents' circumstances

For a straightforward local adoption where SWD has done the preparatory work and both parties consent, a solicitor's role is primarily one of document preparation and court attendance. Fees in this range: HK$8,000–HK$15,000.

For more complex matters — intercountry adoptions, contested consent, High Court proceedings — solicitor fees can reach HK$20,000–HK$30,000 or more depending on the firm and the complexity.

If cost is a concern, you can instruct a solicitor only for the court application phase (rather than using them throughout the entire process) to limit fees.

Accredited Body Service Fees

The three Accredited Bodies — ISS-HK, Mother's Choice, and Po Leung Kuk — are non-profit organisations. They charge service fees to cover the cost of their social work staff, training programmes, and administrative work.

Service fee structures vary and are not always published. Contact each organisation directly for current fee schedules. As a general guide:

  • ISS-HK: focuses on intercountry adoption (India, Thailand). Their fees cover home study services, coordination with overseas authorities, and dossier preparation. Intercountry adoption through ISS-HK will cost more than a local adoption through SWD because of the international coordination involved.
  • Mother's Choice: specialises in infant adoption and is known for its extensive preparation programme. Training and assessment services involve a service fee; contact them directly for current rates.
  • Po Leung Kuk: runs large-scale residential care and manages adoption for children — including older children and those with special needs — in their care system. Service fees apply for adoption assessments conducted through PLK.

Accredited Body fees are separate from court fees and Guardian ad litem fees. Budget for both.

Translation and Notarisation (Intercountry Only)

For intercountry adoptions, your dossier documents need to be notarised and in some cases apostilled (certified for international recognition under the Hague Convention). Certified translation costs depend on language and document volume.

For adoption from India or Thailand via ISS-HK, budget an additional HK$5,000–HK$15,000 for translation, notarisation, and apostille processing. ISS-HK will provide a specific list; costs vary with the receiving country's requirements.

Post-Adoption Costs

Once the adoption order is granted, you'll need to apply for a new birth certificate for the child. This is a standard government fee (a few hundred HKD). If the child needs to be added to travel documents, standard passport fees apply.

Not legally — but practically, for most families, having a solicitor handle the District Court application is worth the cost for the reduced stress alone. The paperwork is procedural rather than complex, but one filing error can set the application back by weeks. If your circumstances are completely straightforward, a competent junior associate at a family law firm can handle this efficiently. You don't need a senior partner for an uncontested adoption.

Ask for a fixed-fee quote rather than an hourly arrangement. Most family law firms in Hong Kong will quote a fixed fee for straightforward adoption applications.
