Maricopa County Adoption: How to File in Superior Court and What to Expect

Maricopa County is where most Arizona adoptions get finalized. As the home of Phoenix and the surrounding metro — Mesa, Scottsdale, Gilbert, Chandler, Glendale — Maricopa handles by far the highest volume of adoption cases in the state. The court process here has specific logistical details that differ from rural counties, and there are resources available to Maricopa families that aren't available elsewhere in Arizona.

Where Adoptions Are Filed in Maricopa County

Adoption petitions in Maricopa County are filed at the Juvenile Court, which operates as part of the Superior Court system. The primary location for adoption filings is:

Maricopa County Superior Court — Juvenile Division 3131 W. Durango Street, Phoenix, AZ 85009

This is the official filing location for adoption cases in the county. For families in the East Valley, there are some hearing locations in Mesa and other suburbs, but filings typically go through the central Durango Street office.

Court Filing Fees: What You Actually Pay

For adoption cases in Maricopa County, court filing fees are waived. You read that correctly — the Superior Court does not charge a filing fee for adoption petitions. This applies to DCS adoptions, private agency adoptions, independent adoptions, and stepparent adoptions.

Separate costs still apply: the home study, legal fees if you have an attorney, and the birth certificate amendment from the Arizona Department of Health Services after finalization. But the court itself does not add to your cost.

The County Attorney Option for DCS Adoptions

This is the most underutilized resource in Maricopa County adoption and one of the least publicized. The Maricopa County Attorney's Office handles adoption petitions for families who adopted through DCS — at no charge to the family.

What this means in practice: if you became a licensed foster parent through DCS, a child was placed in your home, parental rights were terminated, and you are now ready to adopt — you may be able to have the County Attorney's Office prepare and file your adoption petition without hiring a private attorney. The County Attorney's office handles uncontested DCS adoption cases as a standard function.

This is not advertised by private adoption agencies (who have a financial interest in you hiring their recommended attorney) or by most DCS caseworkers (who may not know to mention it). Families pursuing DCS foster-to-adopt should ask their DCS placement specialist about the County Attorney option early in the finalization planning process.

This option is only available for DCS cases — not private agency adoptions, not independent adoptions, and not stepparent or kinship adoptions where DCS was not the placing agency.

Finalization Timeline in Maricopa County

Once you file the Adoption Petition, the timeline to finalization in Maricopa County typically runs 30 to 90 days depending on the child's age and the complexity of the case. Younger children typically finalize faster because fewer investigation steps are required. The court schedules a finalization hearing, at which the judge reviews all required documentation and, if satisfied, signs the Decree of Adoption.

  • Certified Home Study Report and Social Study of the Child
  • Original consents or certified copy of the TPR Order (for DCS cases)

  • Proposed Decree of Adoption

DCS Adoption Resources in Maricopa County

Maricopa County has the densest concentration of Arizona's licensed foster care and adoption agencies. Key agencies serving Maricopa families include:

  • Child Crisis Arizona: Foster care licensing and foster-to-adopt services, strong LGBTQ family support
  • Arizona's Children Association: Public and private tracks, statewide but with major Phoenix presence
  • AASK (Aid to Adoption of Special Kids): Focused on older youth, sibling groups, and children with special needs in Maricopa and Pinal counties
  • Agape Adoption Agency: Faith-based, smaller caseloads, Maricopa and Pinal focus
  • Christian Family Care: East Valley focus, domestic infant and foster-to-adopt

For families pursuing DCS licensing, the primary DCS application portal is at dcs.az.gov. DCS does not charge for its home study process in public adoption cases.

The Adoption Exchange: Finding Waiting Children

DCS operates the Arizona Adoption Exchange — a photolisting of children legally free for adoption who don't yet have a pre-identified family. Families certified through DCS can browse profiles and request to be considered for specific children. Maricopa County has a high volume of children on the exchange, particularly older youth and sibling groups.

Children on the exchange often have special needs or complex backgrounds. Maricopa County families considering this pathway can request meetings with exchange coordinators to learn more about specific children before committing to a placement.
