Mississippi Adoption Subsidy: Rates, Eligibility, and How to Secure Your Agreement

Families adopting from Mississippi's foster care system are often surprised to learn how much financial support is available after finalization. They're also sometimes devastated to learn they missed the deadline to lock in that support — because the agreement must be signed before the final decree is entered. After finalization, you cannot go back.

Here is what you need to know about Mississippi's adoption assistance program before you sit down with your caseworker.

What Is the Mississippi Adoption Assistance Program?

Mississippi's Adoption Assistance Program is administered by the Mississippi Department of Child Protection Services (MDCPS) using a combination of federal Title IV-E funding and state Title IV-B funding. It provides ongoing monthly payments to families who adopt children from foster care who meet the state's "special needs" definition.

The program exists because many children who have been in state custody have needs — medical, developmental, behavioral — that require sustained support. Monthly subsidies are designed to ensure these children can be adopted into permanent families rather than remaining in institutional care indefinitely.

Which Children Qualify: The Special Needs Definition

To receive adoption assistance, MDCPS must certify the child as "special needs" under at least one of the following criteria:

  • Age: The child is two years of age or older
  • Sibling group: The child is part of a sibling group of two or more children placed together for adoption
  • Disability: The child has an established physical, developmental, mental, or severe emotional disability
  • Medical fragility: The child has one or more chronic, life-threatening medical diagnoses
  • At-risk history: The child has a documented history of severe physical abuse or neglect that places them at high risk of developing future physical or mental illness

The at-risk history designation qualifies for a $0 monthly payment agreement — meaning no monthly cash payment — but the child remains eligible for active Medicaid enrollment, which is the most important practical benefit for many families.

Most children in Mississippi's foster care system who are available for adoption qualify under the age criterion alone, since the majority are two or older.

Current Monthly Rates (2025/2026)

The Olivia Y. consent decree's 2nd Modified Settlement Agreement, effective October 1, 2022, permanently linked Mississippi adoption assistance rates to 75% of the state's foster care board rates. The basic monthly maintenance rates by age are:

Child's Age Monthly Rate
Ages 0–3 $325 per month
Ages 4–5 $335 per month
Ages 6–9 $355 per month
Ages 10–12 $375 per month
Ages 13–15 $390 per month
Ages 16–21 $400 per month

Children with more significant clinical needs qualify for higher specialized rates:

Level Monthly Rate Eligibility
Special Needs I $440 per month Chronic medical conditions requiring daily medication or physical intervention; SSI pending or denied
Special Needs II $500 per month Actively receiving SSI at time of finalization
Therapeutic Rate Up to $700 per month Multiple psychiatric or complex medical diagnoses with severe impairment across settings
Medically Fragile Rate $900 per month Life-threatening conditions requiring specialized home medical equipment or recurring major surgeries

Securing the correct rate tier requires clinical documentation. If your child has diagnoses that could qualify for a specialized or therapeutic rate, the supporting clinical records need to be compiled and submitted to MDCPS before the adoption assistance agreement is finalized.

Medicaid Continuation

Any child who qualifies for Title IV-E or Title IV-B adoption assistance automatically becomes eligible for Mississippi Medicaid. This is often the most valuable component of the program for families adopting children with medical or behavioral health needs.

Mississippi Medicaid acts as the primary insurer for covered services — medical, dental, and psychiatric care. This coverage continues regardless of the adoptive family's income, other insurance, or geographic changes within the state.

For children with serious medical conditions, the annual value of Medicaid coverage often exceeds the monthly cash payments significantly.

Non-Recurring Expense Reimbursement

In addition to ongoing monthly payments, adoptive families finalizing a special needs adoption are eligible for reimbursement of one-time, non-recurring adoption expenses. The state reimburses approved expenses — attorney fees, filing fees, court costs — up to $600 per child.

This reimbursement is separate from the monthly assistance agreement. Keep itemized receipts for all legal and court costs and submit them to MDCPS as part of the adoption finalization process.

The Deadline That Cannot Be Missed

This is the most important fact about Mississippi's adoption assistance program:

The formal Adoption Assistance Agreement must be signed by both the adoptive parents and MDCPS before the Chancery Court enters the final decree of adoption.

If you finalize your adoption without a signed agreement in place, you lose all eligibility. There is no appeals process, no waiver, and no retroactive enrollment. The finalization date is the hard cutoff.

This deadline catches families by surprise because the signing of the agreement can feel like a formality in the midst of a chaotic finalization process. It is not a formality. Confirm with your MDCPS caseworker that the agreement is signed before you appear in Chancery Court.

How to Apply

The adoption assistance process runs through MDCPS. The steps:

  1. Confirm special needs certification: MDCPS must formally certify the child as "special needs" based on age, sibling status, or clinical diagnosis. Ask your caseworker for written confirmation of this certification early in the process.

  2. Determine eligibility tier: Verify whether the child qualifies for Title IV-E (federal) or Title IV-B (state) assistance. Title IV-E has broader post-adoption portability and is generally preferable.

  3. Gather clinical documentation: If the child has medical or behavioral health diagnoses that could qualify for a specialized, therapeutic, or medically fragile rate, compile the relevant clinical records and submit them for rate-tier evaluation before the agreement is signed.

  4. Confirm Medicaid enrollment: Make sure the child's Medicaid enrollment forms are completed and attached to the assistance file.

  5. Sign the agreement before finalization: The agreement must be fully executed by both parties before the final decree is entered in Chancery Court. Do not proceed to finalization without written confirmation that the agreement is signed.

Tax Credits Stacked on Top of Assistance

Adoption assistance payments do not eliminate eligibility for the federal Adoption Tax Credit. Families finalizing a special needs adoption can claim the full federal credit — $17,280 per child for 2025 — regardless of whether they receive monthly subsidy payments, as long as the child meets the special needs definition.

Mississippi's own state adoption tax credit (enacted 2023) adds $10,000 for adoption of a child who was a Mississippi resident before adoption, nonrefundable but carrying forward for up to five succeeding tax years.

Combined, the federal and state tax credits, monthly subsidy payments, Medicaid coverage, and non-recurring expense reimbursement create a substantial financial support structure for Mississippi families who adopt from foster care.
