What Is the Mississippi Adoption Assistance Program?

Mississippi's Adoption Assistance Program is administered by the Mississippi Department of Child Protection Services (MDCPS) using a combination of federal Title IV-E funding and state Title IV-B funding. It provides ongoing monthly payments to families who adopt children from foster care who meet the state's "special needs" definition.

The program exists because many children who have been in state custody have needs — medical, developmental, behavioral — that require sustained support. Monthly subsidies are designed to ensure these children can be adopted into permanent families rather than remaining in institutional care indefinitely.

Which Children Qualify: The Special Needs Definition

To receive adoption assistance, MDCPS must certify the child as "special needs" under at least one of the following criteria:

• Age: The child is two years of age or older
• Sibling group: The child is part of a sibling group of two or more children placed together for adoption
• Disability: The child has an established physical, developmental, mental, or severe emotional disability

Non-Recurring Expense Reimbursement

In addition to ongoing monthly payments, adoptive families finalizing a special needs adoption are eligible for reimbursement of one-time, non-recurring adoption expenses. The state reimburses approved expenses — attorney fees, filing fees, court costs — up to $600 per child.

This reimbursement is separate from the monthly assistance agreement. Keep itemized receipts for all legal and court costs and submit them to MDCPS as part of the adoption finalization process.

The Deadline That Cannot Be Missed

This is the most important fact about Mississippi's adoption assistance program:

The formal Adoption Assistance Agreement must be signed by both the adoptive parents and MDCPS before the Chancery Court enters the final decree of adoption.

If you finalize your adoption without a signed agreement in place, you lose all eligibility. There is no appeals process, no waiver, and no retroactive enrollment. The finalization date is the hard cutoff.

How to Apply

The adoption assistance process runs through MDCPS. The steps:

2. Determine eligibility tier: Verify whether the child qualifies for Title IV-E (federal) or Title IV-B (state) assistance. Title IV-E has broader post-adoption portability and is generally preferable.

3. Gather clinical documentation: If the child has medical or behavioral health diagnoses that could qualify for a specialized, therapeutic, or medically fragile rate, compile the relevant clinical records and submit them for rate-tier evaluation before the agreement is signed.

4. Confirm Medicaid enrollment: Make sure the child's Medicaid enrollment forms are completed and attached to the assistance file.

5. Sign the agreement before finalization: The agreement must be fully executed by both parties before the final decree is entered in Chancery Court. Do not proceed to finalization without written confirmation that the agreement is signed.

Tax Credits Stacked on Top of Assistance

Adoption assistance payments do not eliminate eligibility for the federal Adoption Tax Credit. Families finalizing a special needs adoption can claim the full federal credit — $17,280 per child for 2025 — regardless of whether they receive monthly subsidy payments, as long as the child meets the special needs definition.

Mississippi's own state adoption tax credit (enacted 2023) adds $10,000 for adoption of a child who was a Mississippi resident before adoption, nonrefundable but carrying forward for up to five succeeding tax years.
